Summary

Butte County requires a Building Official inspection before most new buildings can be occupied. Section 26-3.1(a) amends the California Building Code's Section 111.1 to bar occupancy or a change of use until a certificate of occupancy issues, and amends Section 111.2 to spell out the twelve items that certificate must contain. Single-family homes and most accessory structures are exempted from the certificate requirement.

City-specific rules exist: Chico has its own building inspections rules that differ from Butte County's county-level regulations. If you live in Chico, check the city-specific page instead.

Section 111.2 "Certificate issued" is amended to read as follows: Except for Group R, Division 3, and Group U Occupancies, after the building official inspects the building or structure and does not find violations of the provisions of this code or other laws that are enforced by the County, the building official shall issue a certificate of occupancy that contains the following: 1. The building permit number. 2. The address of the structure. ... 10. The design occupant load. 11. If an automatic sprinkler system is provided, whether the sprinkler system is required. 12. Any special stipulations and conditions of the building permit.

Full Breakdown

Section 26-3.1(a) amends two sections of the California Building Code to set Butte County's final inspection and occupancy process. Section 111.1 "Change of occupancy" is amended to read: "No building or structure shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the building official has issued a certificate of occupancy therefor as provided herein," with a stated exception for "Group R, Division 3, and Group U Occupancies," which covers single-family homes and most private garages and accessory structures.

Section 111.2 "Certificate issued" is amended to require that, after the building official inspects the building and finds no violations of the code or other County-enforced laws, the certificate of occupancy must contain twelve specific items: the building permit number; the structure's address; the owner's or authorized agent's name and address; a description of the portion of the structure covered; a statement that the structure was inspected for code compliance; the building official's name; the code edition under which the permit issued; the use and occupancy classification; the type of construction; the design occupant load; whether an automatic sprinkler system is required; and any special stipulations or conditions of the building permit. The Director of Development Services must also certify to the floodplain administrator, under Section 26-24(d), that construction complies with the county's flood-hazard standards before that certification is complete for property within a flood zone.

Violations & Fines

Occupying or changing the use of a building before the Building Official issues the required certificate of occupancy violates Section 111.1 as amended by Section 26-3.1. Issuance of the certificate does not excuse other code violations, so the Building Official can still require correction. Where no specific penalty applies, Section 1-7 sets a general fine of up to one thousand dollars, up to six months in county jail, or both, with each day of continued unlawful occupancy a separate offense.

Frequently Asked Questions

Does a single-family home need a certificate of occupancy in Butte County?
No. Section 26-3.1(a)'s amendment to Section 111.1 exempts "Group R, Division 3, and Group U Occupancies" from needing a certificate of occupancy. That covers a single-family home and most private garages and small accessory structures built on the same residential lot in the county.
What has to be on a Butte County certificate of occupancy?
Twelve items, listed in the Section 111.2 amendment: the building permit number, the structure's address, the owner's or agent's name and address, a description of the portion certified, a compliance statement, the building official's name, the code edition, use and occupancy, construction type, design occupant load, sprinkler status, and any special permit conditions.
What has to happen before the certificate of occupancy is issued?
The building official must first inspect the building and confirm there are no violations of the Building Code "or other laws that are enforced by the County," per Section 111.2 as amended by Section 26-3.1. Only after that inspection can the certificate of occupancy be issued and the space lawfully occupied.
