Federal lead-disclosure rules under 24 CFR Part 35 (HUD/EPA) also apply at lease signing and sale of any pre-1978 dwelling.
Failure to obtain a Lead-Safe Certification when required is a violation of N.J.S.A. 52:27D-437.16 and is enforceable by the local enforcing agency. The statute provides for civil penalties up to $1,000 per week of non-compliance, plus the township can refuse to issue or renew the rental license under Chapter 17 (Housing) until certification is current. Identified lead-based paint hazards must be addressed promptly under the statute, with re-inspection at owner cost.
