Federal EPA RRP Rule requires certified renovators when disturbing lead paint in pre-1978 homes. Texas DSHS administers the lead-based paint program. Disclosure required in real estate transactions.
Lead paint in Irving is regulated under federal EPA Renovation, Repair, and Painting (RRP) Rule (40 CFR 745). Contractors disturbing lead-based paint in homes built before 1978 must be EPA-certified. The Texas Department of State Health Services (DSHS) administers the state lead-based paint activities program. Sellers and landlords of pre-1978 housing must disclose known lead-based paint hazards under federal law (42 USC 4852d). Renovation work in target housing that disturbs more than 6 square feet of interior paint or 20 square feet of exterior paint per component requires certified renovator practices. Child-occupied facilities have additional protections. Texas does not have additional state-level lead paint requirements beyond the federal program.
EPA RRP violations carry federal fines up to $37,500 per day. Failure to disclose: liability for damages.
