Full Breakdown

Sec. 2 below lists the Bulk Requirements for the R-1, R-2, R-3, R-4 and R-5 Zone Districts. " Row G of that table sets Maximum LOT COVERAGE at 50% for R-1 (Low-Density Residential), 50% for R-2 (Duplex Residential), 60% for R-3 (Medium-Density Residential), 70% for R-4 (High-Density Residential, no longer permitted to be created after July 25, 2019 per Sec. 23-3-140), and 60% for R-5 (Manufactured Home Residential). The same table sets a 6,000-square-foot minimum lot size in R-1, R-2, R-3, and R-5, dropping to 3,000 square feet in R-4, and a 50-foot minimum lot width across all five districts, so the coverage percentage always applies against a lot that already meets those size floors.

A landowner who wants a structure that would push a lot over its row-G cap does not simply get denied: Sec. 2 lists "STRUCTURES exceeding maximum LOT COVERAGE" as a Use by Special Review in the R-1 district, with the identical provision repeated for R-2 through R-5, meaning the Planning Commission and Board of County Commissioners can approve an exception through the same $3,000 Special Review process used for Child Care Centers and other higher-impact uses. Outside the residential districts, the Commercial and Industrial Zone Districts run on a separate, more permissive bulk standard, Sec. 23-3-250(D) and Sec. 23-3-340(D), which each cap lot coverage at 85 percent instead of the 50-70% residential range.

Violations & Fines

Building or maintaining a structure that exceeds the Table 23.2 lot coverage cap without an approved Special Review Permit is an unlawful use of land under Sec. 23-10-20, a misdemeanor carrying up to a $100 fine or 10 days in jail per day of violation. Sec. 23-10-40 also allows the County Attorney to pursue a civil penalty of $25 to $1,000, plus a continuing penalty of up to $100 for each day the excess coverage remains, which can be recorded as a lien against the property.

Frequently Asked Questions

What percentage of my lot can I cover with buildings in Weld County's R-1 zone?
Table 23.2 in Sec. 23-3-160 caps Maximum LOT COVERAGE at 50 percent for R-1 (Low-Density Residential) lots, the same cap that applies in the R-2 Duplex Residential district. Coverage is measured against a lot that already meets the district's 6,000-square-foot minimum lot size.
Which residential zone in Weld County allows the most lot coverage?
R-4 (High-Density Residential) has the highest cap in Table 23.2 at 70 percent, though no new land can be rezoned to R-4 after July 25, 2019 under Sec. 23-3-140(A). R-3 (Medium-Density) and R-5 (Manufactured Home) are both capped at 60 percent.
Can I get an exception to build past the lot coverage limit?
Yes. Sec. 23-3-110.F.2 lists structures exceeding the maximum lot coverage as a Use by Special Review, which means a $3,000 application, a Planning Commission hearing, and a Board of County Commissioners hearing under Secs. 23-2-220 and 23-2-230 before the excess coverage can be approved.
Are commercial and industrial lots in Weld County held to the same coverage cap as houses?
No. Secs. 23-3-250(D) and 23-3-340(D) each allow up to 85 percent lot coverage in the Commercial and Industrial Zone Districts, well above the 50 to 70 percent range that applies to the R-1 through R-5 residential districts under Table 23.2.
