Summary

Gaston County's standard zoning tables set no maximum lot-coverage percentage; Tables 7.1-2 through 7.1-5 regulate lot size, setbacks, and height but never cap building or impervious coverage. The real coverage limit lives in Chapter 15's Water Supply Watershed Regulations, which cap built-upon area inside the county's mapped watershed districts, from six percent in a critical area up to 24 percent or more in a balance-of-watershed district.

These county ordinances apply to unincorporated areas of Gaston County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

C.Buffalo Creek WS-III-BW (Balance of Watershed), referred to as: BCWSIII-BW. In order to maintain low to moderate land use intensity, single family detached uses shall develop at a maximum of two dwelling units per acre (2 du/ac). All other residential and non-residential development shall be allowed at a maximum of 24 percent built-upon area. In addition, new development and expansions to existing development may occupy ten percent of the balance of the watershed area with up to 70 percent built-upon area when approved as a Special Intensity Allocation (SIA).

Full Breakdown

1-5 govern minimum lot area, lot width, and setbacks for every general zoning district in the county, but none of those tables include a maximum lot-coverage, building-coverage, or impervious-surface-ratio column for standard residential, office, commercial, or industrial districts. 'Impervious Surface Ratio' is a defined term in the ordinance's definitions section, but it is not tied to a numeric ceiling outside the watershed chapter. That numeric ceiling exists in Chapter 15, Water Supply Watershed Regulations, adopted under state law and covering the mapped Watershed Protection districts that overlay parts of unincorporated Gaston County (and, by interlocal agreement, parts of Bessemer City, Cherryville, Dallas, and Stanley).

2 sets a different built-upon-area cap for each watershed classification: six percent in the Long Creek WS-II critical area, 12 percent in the Long Creek and Indian Creek WS-II balance-of-watershed areas (with up to 70 percent allowed on a limited share of the watershed under an approved Special Intensity Allocation), 24 percent in the Buffalo Creek WS-III balance-of-watershed area, and 24 percent, or 36 percent for projects without curb and gutter, in the Catawba River, South Fork River, and Mountain Island Lake WS-IV districts. 8 must issue before any built-upon area is added within these districts.

Violations & Fines

Adding built-upon area beyond a watershed district's cap, or building without the required Watershed Protection Permit, is a misdemeanor under Section 15.2.6, punishable by up to $500 per offense with each day of continuing violation a separate offense. The Board of Commissioners may also pursue a civil penalty of $100 per day under Section 15.2.7, in addition to injunctive relief to restrain or abate the violation.

Frequently Asked Questions

Does Gaston County limit how much of my lot can be covered with buildings or pavement?
Not under the standard zoning tables in Section 7.5, which set lot size, setbacks, and height but no coverage percentage. A built-upon area limit only applies if your property lies inside a mapped Water Supply Watershed Overlay District under Chapter 15.
What's the impervious limit inside a watershed protection area?
It depends on the district classification, ranging from six percent built-upon area in the Long Creek critical area to 24 percent in the Buffalo Creek and Catawba River balance-of-watershed districts, under Section 15.5.2. Some districts allow up to 70 percent on a limited share of land through an approved Special Intensity Allocation.
Who enforces the watershed built-upon area limits?
The Watershed Administrator, who issues the required Watershed Protection Permit under Section 15.5.8 and can pursue a misdemeanor charge carrying up to a $500 fine per offense under Section 15.2.6, plus a $100-per-day civil penalty under Section 15.2.7.
