Full Breakdown

Sec. 2-218(B)(1) defines building coverage as the portion of a lot covered by a building's footprint, along with any attached porches, accessory structures, decks, and balconies; it specifically excludes driveways, streets, sidewalks, outdoor storage areas, and other impervious surfacing, so Portsmouth's zoning code does not set a separate citywide impervious-surface cap outside this building-footprint measure. 2-218(1) in Sec. 2-218(G) then sets the maximum percentage by district: 45 percent in both the Neighborhood Residential (NR) and General Residential (GR) districts, 55 percent in Urban Residential (UR), and 65 percent in Urban Residential-Mixed (UR-M), tracking the smaller minimum lot sizes and higher densities permitted as the district numbers rise.

Building coverage is calculated against the full lot size as defined in Sec. 2-218(A)(1), excluding public rights-of-way and land below the mean high-water mark. In the historic districts, Sec. 2-206(E)(1) applies a different limit: a flat 70 percent maximum building coverage across Truxtun, Cradock, Port Norfolk, Olde Towne, and Park View, regardless of the base zoning district a historic lot would otherwise carry. A property owner proposing a building footprint, porch, deck, or accessory structure that would push coverage over the applicable percentage must either redesign the project or seek relief from the Board of Zoning Appeals. Compliance is checked at the Zoning Permit (Sec. 2-530) or Site Plan (Sec. 2-540) review stage, before construction begins.

Violations & Fines

Exceeding the maximum building coverage percentage for a lot's district is a zoning violation caught at Site Plan or Zoning Permit review; if discovered after construction, the Zoning Administrator can order the excess structure removed or altered, and a continuing violation is a misdemeanor under Sec. 40.2-553 with fines up to $1,000.00 that increase for repeated 10-day periods of noncompliance.

Frequently Asked Questions

What counts toward Portsmouth's building coverage limit?
Sec. 40.2-218(B)(1) counts a building's footprint plus any attached porches, accessory structures, decks, and balconies toward the coverage limit, but excludes driveways, streets, sidewalks, outdoor storage areas, and other impervious paving.
How much of my lot can I build on in Portsmouth?
It depends on your residential district: Table 40.2-218(1) caps building coverage at 45 percent in Neighborhood Residential and General Residential, 55 percent in Urban Residential, and 65 percent in Urban Residential-Mixed.
Is the coverage limit different in a historic district?
Yes. Sec. 40.2-206(E)(1) sets a flat 70 percent maximum building coverage in all five of Portsmouth's historic districts, Truxtun, Cradock, Port Norfolk, Olde Towne, and Park View, regardless of the underlying base zoning district.
Does my driveway count against my lot coverage limit?
No. Sec. 40.2-218(B)(1)(b) specifically excludes driveways, streets, sidewalks, outdoor storage areas, and other impervious surfacing from the building coverage calculation; only the structure's footprint and attached features like porches and decks count.
