Full Breakdown
Article 23 of the Coweta County Zoning and Development Ordinance ('Dimensional Requirements') is the table that fixes minimum yard setbacks district by district; there is no single countywide number. In the RD Two-Family Residential and R-2 Multi-family Residential districts the table lists a front setback of 40 feet, a side setback of 10 feet and a rear setback of 30 feet, with a maximum structure height of three stories or 35 feet. 6 and CSD conservation-subdivision development types drop the side setback to 10 feet and the rear to 40 feet.
Commercial retail districts (C-3 through C-7) require 50 feet in front but only 10 feet on the side and rear, while heavy commercial, light industrial and industrial (C-8, LM, M) districts require 20-foot side and 30-foot rear setbacks. Footnote C to the table specifies that setbacks are measured from the street right-of-way line, except that where the right-of-way is not established the front setback runs 120 feet from the centerline of an arterial or collector street and 100 feet from the centerline of any other street; corner lots must meet the full front setback on both streets.
Section 61 lets an infill lot use the average setback of homes within 200 feet on the same block and same side of the street, but never less than 15 feet from the right-of-way. Section 62 lets the planning director grant limited height exceptions for chimneys, church spires, flagpoles and similar features up to 60 feet.
Violations & Fines
Building or expanding a structure inside the required setback violates Section 300 of the ordinance: a conviction carries a fine of up to $1,000, plus court costs, and each day the encroaching structure remains is a separate offense. Section 301 lets the board of commissioners, the building official, the director, or a damaged adjacent property owner seek an injunction or mandamus to force removal or correction of a setback violation.
