Full Breakdown

Table 2-4 in § 17.215.030 lists minimum setbacks for the RE, RR, RL, RM, RH and RVH zones. Front: 25 feet in RE, 25 feet in RR, 20 feet in RL, and in RM 15 feet for a house and 20 feet for a garage. Interior side: 20 feet in RE and RR, 5 feet in RL and RM. Street side: 20 feet in RE and RR, 10 feet in RL, 7 feet in RM. Rear: 20 feet in RE, RR and RL, and 10 feet in RM. For RH and RVH the table refers to Chapter 17.420 (Multi-Family Development). The table also notes that Appendix 1 of the Landscape Design Guidelines can require greater setbacks on certain streets.

Section 17.305.120 supplies the measurement rules. Each setback area must be open and unobstructed from the ground upward, except for listed exemptions: fences and walls under Chapter 17.315, driveways, walkways, decks, steps and patios placed directly on grade that do not exceed 18 inches above grade, signs, retaining walls less than 30 inches in height, and accessibility improvements such as ramps and chairlifts. Front setbacks are measured at right angles to the front lot line. On a corner lot the front is the lot line adjoining the street to which access is taken. In a residential zone the Director can reduce the front setback for a designated in-fill parcel to the average depth of the front setbacks of the two adjacent parcels, if both have existing structures within 25 feet of the parcel's lot lines that project beyond the required front setback line. The Director also decides how setbacks are measured in situations the section does not cover.

Projections are limited by Table 3-2: brackets, cornices, eaves and roof overhangs project 36 inches maximum into front, side and rear setbacks, and bay windows 30 inches. A thirty-six-inch-wide passageway must stay free of obstructions in at least one side setback adjacent to the primary structure. Any projection into a public right-of-way requires a revocable encroachment permit issued by the City Engineer.

Violations & Fines

Section 17.215.030 prints no penalty of its own, so Chapter 1.24 governs. Building inside a required setback violates a city ordinance and is a misdemeanor under § 1.24.010, punishable by a fine of not more than $1,000, imprisonment not exceeding six months, or both (§ 1.24.020), unless prosecuted as an infraction with fines not exceeding $100, $200 and $500 (§ 1.24.030). Each day is a separate offense under § 1.24.040.
