Sioux Falls uses a form-based zoning code ('Shape Places') where each zoning form (DD1βDD7, AD1βAD4, MD, RE, etc.) specifies its own front, side, and rear setback minimums in bulk-regulation sections of Chapter 160. Averaging of front-yard setbacks is allowed in DD1βDD4 and AD forms.
Chapter 160 (Zoning) of the Sioux Falls Code of Ordinances establishes setback requirements for each form-based zoning district. Detached Dwelling forms (DD1 through DD7) have individual bulk regulation sections (Β§ 160.064 for DD1, Β§ 160.074 for DD2, Β§ 160.084 for DD3, etc.) that set minimum front, side, and rear yard setbacks. Principal structures must be placed no closer than required in the applicable bulk table. In DD1βDD4 and all AD forms, Β§ 160.508 allows front-yard setback averaging when adjacent buildings have shallower setbacks. At least 90% of the required front-yard setback must be landscaped. Accessory structures have separate setback standards under Β§ 160.093. Administrative modifications to a setback of up to 25% may be approved by Planning & Development.
Buildings erected in violation of setback requirements are subject to stop-work orders, code enforcement action, and civil penalties. Nonconforming structures may not be expanded further into setback areas without a variance from the Zoning Board of Adjustment.
