Full Breakdown

The RR Rural Residential District's Purpose clause states plainly that it "is intended for application in unincorporated Sedgwick County," so its property development standards at Sec. d govern most large-lot residential land outside city limits. Every RR site needs a minimum two-acre lot (larger where sewage lagoons serve the property, per Sec. e) and 200 feet of lot width. From there, the setbacks are numeric and specific: 30 feet minimum front setback, 25 feet minimum rear setback, 20 feet minimum interior side setback, and 20 feet minimum street side setback, all measured for the Principal Structure.

Accessory structures follow a separate, generally reduced setback and height table at Sec. e, and front setbacks on unplatted tracts or along major roadways can be adjusted under Secs. e(2) and (3). A compatibility setback under Secs. 5, triggered when RR-zoned land sits next to a different intensity of use, can override the base numbers and require additional separation. Maximum building height in the RR District is 35 feet, rising to 45 feet if the structure sits at least 25 feet from every lot line; there is no height cap at all for barns, silos and similar farm buildings.

Property owners who need relief from these numbers do not have to seek a formal rezoning: under the Zoning Adjustments procedure at Sec. V-I, the Planning Director, with the concurrence of the Director of the Metropolitan Area Building and Construction Department, can administratively approve reducing any Front, Side or Rear Setback by up to 20 percent, or by up to 50 percent when the yard being adjusted abuts a golf course, open space or reserve, or is 300 square feet or smaller. A formal Variance beyond that administrative cap goes to the Board of Zoning Appeals, which requires a complete application, a nonrefundable fee set by the Governing Body, and a noticed public hearing.

Violations & Fines

Reducing a lot so that its setbacks fall short of the RR District minimums is itself listed as a violation type at UZC Article VIII, Sec. VIII-D(5) ("Making lot or setback noncomplying"). For unincorporated Sedgwick County, a confirmed violation is a class H violation prosecuted under Chapter 8 of the Sedgwick County Code, with criminal penalties capped at $500 and each day of the ongoing violation treated as a separate offense. The County can also withhold or revoke permits, stop work in progress, and seek injunctive or abatement relief in district court.

Frequently Asked Questions

What are the setback minimums in unincorporated Sedgwick County's RR District?
Sec. III-B.2.d of the Wichita-Sedgwick County Unified Zoning Code sets a 30-foot minimum front setback, 25-foot minimum rear setback, and 20-foot minimum interior and street side setbacks for Principal Structures on RR-zoned land, which the Code reserves for unincorporated Sedgwick County.
Do accessory buildings like sheds or barns follow the same setbacks?
No. Accessory Structures follow a separate setback and height schedule at Sec. III-D.7.e rather than the Principal Structure numbers in Sec. III-B.2.d, and barns, silos and similar farm buildings in the RR District have no maximum height limit at all.
Can a property owner build closer than the required setback?
Yes, through a Zoning Adjustment. The Planning Director can administratively approve reducing a Front, Side or Rear Setback by up to 20 percent, or up to 50 percent next to a golf course or open space, or where the affected yard is 300 square feet or less; larger relief requires a Variance from the Board of Zoning Appeals.
What is the penalty for building inside the required setback?
Making a lot or setback noncompliant is a listed violation under UZC Article VIII. In unincorporated Sedgwick County it is a class H violation under Chapter 8 of the county code, carrying up to a $500 fine with each day of the violation counted separately, plus possible permit revocation or a stop-work order.
