Summary

Orange County caps most single-family zoning districts, R-1 through R-1AAAA plus the A-1 and A-2 agricultural districts, at 35 feet of building height, regardless of lot size. Section 38-1501's basic site table sets that ceiling alongside minimum lot area, width and yard requirements, while a multifamily building taller than one story within 100 feet of single-family zoned land needs a special exception under footnote E.

City-specific rules exist: Orlando has its own structure height limits rules that differ from Orange County's county-level regulations. If you live in Orlando, check the city-specific page instead.

The basic site and principal building requirements for agricultural, residential, professional office, commercial and industrial zoning districts are established as set forth below. Full Breakdown

Section 38-1501's table of basic site and principal building requirements governs every agricultural, residential, professional office, commercial and industrial zoning district in unincorporated Orange County. For the county's core single-family districts, R-1AAAA, R-1AAA, R-1AA, R-1A and R-1, the maximum building height column reads a flat 35 feet no matter how the minimum lot area shrinks, from a half-acre in R-1AAAA down to 5,000 square feet in R-1; only the required lot width and front, rear and side yards change between them. 5-foot side yards and 25/30-foot front and 30/35-foot rear yards, while R-1 allows a 50-foot-wide lot with only 5- or 6-foot side yards, yet both still cap out at 35 feet.

The Neighborhood Residential (NR) district follows a different curve within the same table: one-, two- and three-unit buildings are capped at 35 feet or 3 stories, but a building with four or more dwelling units in that same NR district can rise to 50 feet or 4 stories. Every district row in the table also carries a 50-foot Normal High-Water Elevation setback under footnote A for any building near a natural water body, though a lot that is part of a lawfully recorded subdivision plat, or a parcel deeded on or before August 31, 1982, with less than 150 feet of depth above the NHWE contour is exempt from that 50-foot setback and instead follows the applicable district's ordinary yard requirements.

Footnote E adds a separate height-related trigger distinct from the table's flat 35-foot column: a multifamily building of more than one story, built within 100 feet of the property line of any single-family zoned district or use, needs a special exception before it can be built, even in a district that would otherwise permit it by right.

Violations & Fines

Exceeding Section 38-1501's height table without an approved special exception or variance is enforced like any other zoning violation: through the Code Enforcement Board under Chapter 11, backed by the county's general penalty in Section 1-9, a fine up to $500, up to 60 days in jail, or both, with each day the excess height continues counted as a separate offense. The county may also pursue injunctive or other equitable relief to bring an oversized structure into compliance.

Frequently Asked Questions

How tall can I build a house in unincorporated Orange County?
In the county's standard single-family districts, R-1, R-1A, R-1AA, R-1AAA and R-1AAAA, Section 38-1501 caps building height at 35 feet no matter the lot size, and the same 35-foot ceiling applies in the A-1 and A-2 agricultural districts.
Can a taller apartment building go up next to my house?
Only with a special exception. Footnote E to Section 38-1501 requires any multifamily building taller than one story to obtain a special exception if it sits within 100 feet of the property line of a single-family zoned district or use.
Is 35 feet the height limit everywhere in the county?
No. The Neighborhood Residential (NR) district allows buildings with four or more units up to 50 feet or 4 stories, and other districts in the Section 38-1501 table carry their own limits; the flat 35-foot cap is specific to the standard single-family and agricultural rows.
Are there exceptions to the 50-foot water body setback?
Yes. Footnote A exempts a lot that is part of a lawfully recorded subdivision plat, or a parcel deeded on or before August 31, 1982, that has less than 150 feet of depth above the Normal High-Water Elevation contour; that lot follows the applicable zoning district's ordinary yard requirements instead of the standard 50-foot NHWE setback.
