Under LDC section 34-695, the maximum height for buildings and structures is 35 feet across every one- and two-family residential district (RSC-1, RSC-2, RSA, RS-1 through RS-5, and the TF districts), measured per section 34-2171. Section 34-2175 imposes special limits that override the general rule: Upper Captiva, Captiva, and San Carlos Island are capped at 35 feet with no variance; Greater Pine Island at 33 feet with no planned-development deviation; and the Gasparilla Island Conservation District at 38 feet above average grade or 42 feet above mean sea level, whichever is lower. Airport hazard zones carry additional limitations.
Exceeding the height limit is a code violation; relief is generally by variance only, and in Upper Captiva, Captiva, and Greater Pine Island no variance or deviation is permitted. Enforcement runs through the Hearing Examiner/Special Magistrate (F.S. 162).
