Rutherford County, NC Building Setbacks & Zoning: Structure Height Limits (2026)

Rutherford County has no general countywide zoning ordinance governing residential building height. The only codified height limit in unincorporated Rutherford County sits in the Airport Zoning Ordinance, Appendix A, Article III, adopted December 7, 1981 and revised November 1, 1999. Section 4 sets zone-specific limits: the horizontal zone (a 10,000-foot radius around each runway end) caps structures and trees at 100 feet above airport elevation, or 1,178 feet above mean sea level. The conical zone beyond it slopes upward 20 feet outward per foot of height to a maximum of 300 feet above airport elevation, while precision and nonprecision approach zones slope 50 feet and 34 feet outward per foot upward respectively.

Section 4(6) carves out a blanket exception: nothing in the ordinance bars a structure or tree up to 70 feet above the surface of the land anywhere, and Section 7 exempts structures under that 70-foot mark from needing a zoning permit at all unless terrain would push them above the applicable zone limit. Anyone wanting to build higher than the applicable limit must apply to the Rutherford County building inspector, who administers Section 8, and a denial can be appealed to the five-member board of appeals for a variance under Section 9, which requires an FAA determination on the proposal's effect on air navigation before it can be granted. Rutherford County Airport Authority may also require marking and lighting on any approved obstruction at its own expense.
