Unified Development Ordinance Sec. 1-2(F)(1), sets a flat 45-foot maximum building height for single-family dwellings, manufactured homes, family care homes, rooming houses and Class A day care centers across all eight conventional residential districts: R-1, R-2, R-3, RLD, RS-20, RS-12, RS-8 and RMF. Two-family dwellings and bed-and-breakfast inns carry the same 45-foot cap, and the table's catchall 'All Other Uses' row applies 45 feet as well. Height is measured under Sec. 8 from the mean elevation of the finished grade at the front of the structure to the highest point of the structure.
Sec. 8(A) allows limited roof-mounted features, such as skylights, elevator housings, water tanks, ventilation equipment, steeples and antennae, to exceed the district maximum without a special permit, but Sec. 8(B) requires any such feature that exceeds the cap by more than ten feet to be set back an additional distance equal to either the district's normal setback or the height overage, whichever is greater. Sec. 8(C) sets an absolute outer limit of 1,000 feet for any structure in any district. 1-2(F)(1). These limits apply only to unincorporated Gaston County parcels; Gastonia, Belmont, Mount Holly, Cherryville, Dallas, Stanley and Bessemer City set their own separate building-height limits within their corporate limits.
Violations & Fines
Constructing a single-family or two-family home taller than 45 feet in a conventional residential district, or adding a rooftop feature that exceeds the height cap by more than ten feet without meeting the added setback in Sec. 9.8(B), violates Table 7.1-2(F)(1) and Sec. 9.8 and can require the county building inspector to withhold a certificate of occupancy until the structure is brought into compliance.
