Summary

Contra Costa County keeps adult bookstores, cabarets, adult theaters, and similar businesses away from homes, schools, and each other. Chapter 88-12 bars any adult entertainment business from opening within five hundred feet of residentially zoned land, one thousand feet of another adult business, or one thousand feet of a school, park, playground, church, or other place likely to draw minors.

City-specific rules exist: Antioch, Brentwood, and San Ramon have their own adult entertainment rules that differ from Contra Costa County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

In land use zoning districts where the adult entertainment businesses regulated by this chapter would otherwise be permitted uses, it shall be unlawful to establish any such adult entertainment business if the location is:

(1)Within five hundred feet of any area zoned for residential use; or(2)Within one thousand feet of any other "adult entertainment" business; or(3)Within one thousand feet of any public or private school, park, playground, public building, church, any noncommercial establishment operated by a bona fide religious organization, or any establishment likely to be used by minors.

Full Breakdown

The county's 1981 adult entertainment ordinance, Chapter 88-12, was written 'to prevent the concentration or clustering' of these businesses so they do not blight surrounding neighborhoods, per Section 88-12.202. Section 88-12.404 defines nine specific categories that trigger the rules: adult bookstores, adult motion picture theaters, adult mini motion picture theaters, adult hotels or motels, adult motion picture arcades, cabarets featuring topless or nude performers, massage parlors, model studios, and sexual encounter centers, plus a catchall for any other business emphasizing specified sexual activities or specified anatomical areas as those terms are defined in Sections 88-12.406 and 88-12.408.

Section 88-12.602 sets three distance floors: five hundred feet from any area zoned for residential use, one thousand feet from any other adult entertainment business, and one thousand feet from a public or private school, park, playground, public building, church, other religious nonprofit facility, or any establishment likely to be used by minors. These distances apply even in zoning districts where the business type would otherwise be a permitted use.

Section 88-12.604 makes clear the rule reaches more than brand-new businesses: opening a new adult entertainment business, relocating one, or converting an existing business into one all count as 'establishing' a business under the chapter. An operator who cannot meet the spacing standards has one avenue left: Section 88-12.802 lets the planning agency grant a land use permit modifying the location rules under Chapters 26-2 and 82-6, but only after making the finding required by Section 26-2.2008.

Violations & Fines

Establishing an adult entertainment business inside a prohibited buffer is a zoning violation. Because Chapter 88-12 does not set its own penalty schedule, the county enforces it the way it enforces other zoning violations: through the countywide Uniform Public Nuisance Abatement Procedure in Chapter 14-6, which authorizes a notice and order to discontinue or relocate the use, an appeal to the Board of Supervisors, and a property lien for unpaid abatement costs. Operating without first obtaining the Section 88-12.802 variance forecloses that relief entirely.

Frequently Asked Questions

How close can an adult bookstore be to a school in Contra Costa County?
It can't be within one thousand feet. Section 88-12.602(3) of the Ordinance Code bars any adult entertainment business, including an adult bookstore, from locating within one thousand feet of a public or private school, park, playground, public building, church, other religious nonprofit facility, or any establishment likely to be used by minors, even in a zoning district that would otherwise allow it.
Can two adult entertainment businesses locate on the same block?
No. Section 88-12.602(2) prohibits establishing an adult entertainment business within one thousand feet of any other adult entertainment business, a rule the ordinance's purpose section explains is meant to prevent the 'concentration or clustering' of these uses, which the county found could blight or downgrade the surrounding neighborhood. Converting an existing business into an adult use counts as 'establishing' one under Section 88-12.604.
What if the only available property doesn't meet the spacing rule?
The operator can apply for a land use permit that modifies the location standards in Article 88-12.6, as allowed by Section 88-12.802. The planning agency reviews the request under Chapters 26-2 and 82-6 and, before granting it, must make the specific finding required by Section 26-2.2008; there is no automatic exception for a location that otherwise fails the spacing test.
