02 (Adult Bookstores) applies only in the unincorporated area of the county; Marysville and Wheatland enforce their own municipal codes, so a store inside either city limit falls outside this ordinance. 010 states the rule in one sentence: no person shall operate an adult bookstore in proximity to a school. 020 supplies the definitions that make the ban work. An 'adult bookstore' is a place in the unincorporated county where the operator keeps 'harmful matter' for sale, trade, advertising or display to entrants. 'Harmful matter' is matter whose predominant appeal, under contemporary standards, is to prurient interest in nudity, sex or excretion, that goes substantially beyond customary limits of candor, and that is utterly without redeeming social importance for minors.

'Proximity to' means within 1,000 feet, measured in a straight line between the nearest points on the bookstore's and the school's respective property lines, where a grand jury or magistrate could find probable cause that children under 17 have a reasonable opportunity to view the harmful matter while not under a parent's or guardian's immediate control. 'School' reaches any public or private institution substantially enrolling children under 17, including nursery schools and schools for handicapped children, but excludes colleges, universities, business schools and most vocational schools.
