Instead of a dedicated adult-business license, San Jose zones these uses out of most of the city. Municipal Code § 20.80.030 bars locating an adult book/video store, adult motion picture theater, adult entertainment establishment or massage parlor within 200 feet of any residentially zoned or TM-zoned lot, or within 500 feet of any school, college or university, inside or outside city limits. A companion anti-clustering rule, § 20.80.020, separately confines these same uses to the CG commercial district (or an equivalent planned development), keeps them out of the downtown core, and requires 200 feet of separation from any other such use. A narrow carve-out lets a qualifying massage parlor sit closer than 200 feet to another massage parlor or to residential zoning if it occupies at least a 35-acre regional-commercial site inside a shopping center of 250,000+ square feet.
