Except as provided in subsection 4, it is unlawful to commence operating an adult bookstore, adult drive-in theater, adult hotel or motel, adult interactive cabaret, adult motion picture arcade, adult motion picture theater, or model studio if, at the time of application, there is within 1,000 feet or less any public or licensed private kindergarten, elementary school, junior high school, middle school, high school, college, university; licensed day-care center; public park or recreational area; church or religious educational center; civic building in which the public frequents; or other adult characterized business. ... an adult characterized business enumerated in subsection 1 may only be located in the industrial regulatory zoning category or in an establishment holding an unlimited gaming license located in a tourist commercial regulatory zoning category. The section further confines these businesses to the industrial regulatory zoning category, or to an establishment holding an unlimited gaming license in a tourist commercial zone, and separately bars them from locating within 1,000 feet of any residentially zoned area or of an unlimited-gaming establishment.
Distances are measured as a straight line from the affected use's property line to the nearest edge of the building housing the adult business, without regard to intervening structures. A business that cannot meet the distance rule can apply to the Board of County Commissioners for a waiver; the county clerk must set a public hearing within 45 days of a complete application, and the board can grant it only after finding the use will not cluster with other adult businesses, increase crime, sit in an area minors frequent, contribute to blight, or otherwise harm public health, safety, or welfare.

Commencing or operating an adult characterized business inside the 1,000-foot buffer, outside the required industrial or gaming-zoned tourist commercial area, or without the structural safeguards required by WCC 25.0531 is a licensing violation the License Division and sheriff enforce. Workers also need a five-year sheriff-issued work permit under WCC 25.0533, which can be denied for prostitution, lewd conduct, solicitation, sexual assault, indecent exposure, or drug trafficking convictions within the past ten years.
