These county ordinances apply to unincorporated areas of Brevard County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Adult entertainment establishments legally in existence and operating on the date that any ordinance amendments are passed by the board are granted permission to file an application for a license under this article or otherwise comply with the amended adult entertainment code not later than 55 days after the date the amendments are passed by the board.(b)Adult entertainment establishment licenses referred to in this article shall be one of four separate types of licenses, which are classified as follows:(1)Adult bookstore.(2)Adult motion picture theatre.(3)Leisure spa.(4)Adult dancing.(c)An adult entertainment establishment shall be limited to one of the four classes of licenses and thereby limited to the one type of activity for which the license is issued. Full Breakdown

Brevard County licenses massage businesses as 'leisure spa establishments' under its Adult Entertainment Code, Chapter 62, Article XV, Division 4. Operating without a county code compliance department license is unlawful (§ 62-4951). The annual fee is $250 (§ 62-4957), and code compliance, the sheriff's office, environmental health, planning and zoning, and public safety jointly investigate every application. Licensed leisure spas shall not operate between 10:00 p.m. and 9:00 a.m. (§ 62-5026), must provide separate dressing rooms and showers for each sex, and employees shall not perform services on a patron of the opposite sex (§ 62-5021(b)(17)). The rule applies only in unincorporated Brevard. Melbourne, Palm Bay, Titusville, Cocoa and other cities license massage businesses under their own codes.

Violations & Fines

Operating an unlicensed leisure spa/massage establishment is a code violation; the county can suspend or revoke the license, and violators are punished under Florida general law (F.S. § 125.69).

Frequently Asked Questions

Does Brevard County license massage therapists?
No: individual therapists are licensed by the state under F.S. Chapter 480. The county instead licenses the business location, called a 'leisure spa establishment,' under Code § 62-4951.
What hours can a leisure spa operate in Brevard County?
Licensed leisure spas must close between 10:00 p.m. and 9:00 a.m., and patrons cannot remain on the premises during those hours, under Code § 62-5026.
Does this license apply inside Melbourne or Palm Bay?
No. Brevard's leisure spa licensing covers only unincorporated areas; Melbourne, Palm Bay, Titusville, Cocoa and other cities regulate massage businesses under their own municipal codes.
