Full Breakdown
03, Division 2 governs every massage establishment, massage technician, and massage practitioner operating in the city. 202 makes it unlawful to conduct a massage establishment without a license from the community development director, and a separate license is required for each location. Applicants file with the director under Sec. 206, supplying five years of address and employment history, fingerprints, a passport photo, all criminal convictions, and disclosure of any prior license revocation or suspension, plus identical background information for every employee. 204 requires a nonrefundable application fee set by city council resolution to cover the cost of investigation, and licenses must be renewed annually for a further resolution-set fee.
The director has 60 working days under Sec. 208 to issue the license or mail written reasons for denial, and must deny it for material misstatements, disqualifying criminal history within the past eight years defined in Sec. 200(9), noncompliance with building, fire, zoning or health codes, an applicant under 18, or any Penal Code Sec. 290 sex-offender registrant among the owners, operators, or staff. m. A massage practitioner may only perform an off-site massage when a licensed physician, surgeon, chiropractor, or osteopath prescribes it in writing, under Sec. 210(17). A denied or revoked applicant may appeal to the city council within 30 days under Sec. 140.
Violations & Fines
Operating without a license, keeping the establishment open past 9 p.m. or before 7 a.m., or employing a person with disqualifying criminal history is enforceable through license denial or revocation under Sec. 5.03.208 and 5.03.216, and general Code violations are misdemeanors under Sec. 1.01.200 and Sec. 1.01.230, punishable by up to a $1,000 fine, six months in county jail, or both, with each day a separate offense.
