There is hereby created a classification known as the Adult Business (AB) Overlay Zone... Under Mission Viejo Municipal Code Sec. 015, adult businesses may locate only within the city's AB Overlay Zone, and no more than three adult businesses may operate within the same underlying planning area at once. Before opening, an operator must obtain a conditional use permit under Sec. 025 and a separate adult business license under Sec. 045; the license cannot be sold, transferred, or assigned, and doing so voids it. The planning commission must act on a CUP application within 45 days of acceptance as complete (Sec.
030), and any appeal to the city council must be filed with the city clerk within 15 days and heard within 30 days. Sec. m. Sec. 050 requires a written application to the community development department disclosing owners, managers, floor plans, and hours, plus a nonrefundable filing fee set by council resolution; the director has 45 days to grant or deny it under Sec. 060, and Sec. 070 lists disqualifying grounds including certain sex-crime convictions and prior license revocations within two years. Licenses expire one year from issuance (Sec.
080) and are subject to revocation under Sec. 085 after investigation, notice, and hearing. Sec. 055 gives the police department and other city departments 25 days to complete an investigation of any new application.
Violations & Fines
Operating without both the conditional use permit and the adult business license, or after hours between 10:00 p.m. and 8:00 a.m., is grounds for license revocation under Sec. 9.15.085. Selling, transferring, or assigning a license, or converting the business to a different type of adult use without city approval, automatically voids the license. Refusing a lawful inspection by the sheriff's department, health department, fire department, code enforcement, or planning department under Sec. 9.15.075 is itself a violation of the chapter.
