Summary

York County zoning allows tattoo and body piercing establishments only as a conditional or special exception use under the § 155.271 Use Table, and every studio must sit at least 300 feet from any other tattoo or piercing business under § 155.596. The rule reaches only the unincorporated county: Rock Hill, Fort Mill, York, Clover and Tega Cay license these shops under their own separate city codes.

City-specific rules exist: Rock Hill has its own tattoo & body modification rules that differ from York County's county-level regulations. If you live in Rock Hill, check the city-specific page instead.

Full Breakdown

Under Subpart 3.36 of the York County Zoning Ordinance, a tattoo and body piercing establishment is not a by-right use anywhere in the unincorporated county. Section 155.595 applies the subpart to every tattoo and body piercing establishment use the Use Table at § 155.271 lists as a conditional use or special exception use, meaning an applicant must win approval from the Zoning Administrator (conditional use) or the Board of Zoning Appeals (special exception) before opening. The Use Table marks the 'Tattoo and Body Piercing Establishments' entry as a conditional use in the county's general and neighborhood commercial columns and prohibits it outright everywhere else, so confirming the parcel's zoning district is the first step for any operator.

Once a district allows the use, § 155.596 layers on a spacing rule: a tattoo and body piercing establishment 'shall be located at least 300 feet from any other tattoo and body piercing establishment,' which caps how many studios can cluster along the same commercial corridor. The code's definitions describe TATTOO as 'the process of applying an indelible mark or color to the skin by subcutaneous introduction of nontoxic dyes or pigments,' expressly excluding tattoo removal, branding, cutting, scarification and skin braiding, while BODY PIERCING covers creating a permanent opening in the body to insert jewelry. Because this sits in the zoning chapter, it governs location and use, not sanitation; studios still need the separate state health permits that apply statewide. Approvals run through the Planning and Development Services Department, and a conditional-use or special-exception decision can be appealed to the York County Board of Zoning Appeals.

Violations & Fines

Operating a tattoo or body piercing establishment without the required conditional-use or special-exception approval, or inside the 300-foot buffer from another such establishment, is a misdemeanor under § 155.9999, punishable by a fine of up to $500 per day for each day the violation continues. The County Attorney, Zoning Administrator or Planning and Development Services Director can prosecute in county court, and the county may also seek an injunction or revoke the underlying zoning approval.

Frequently Asked Questions

Can I open a tattoo shop anywhere in York County?
No. Tattoo and body piercing establishments are conditional or special exception uses under the § 155.271 Use Table, so they're allowed only in specific commercial districts and only after the Zoning Administrator or Board of Zoning Appeals approves the location. A blank cell in the Use Table means the use is prohibited outright in that district.
How far apart must two tattoo studios be?
Section 155.596 requires at least 300 feet between any tattoo and body piercing establishment and any other tattoo and body piercing establishment, which limits how many shops can operate along the same commercial strip regardless of the district's zoning.
Does this rule apply in Rock Hill or Fort Mill?
No. This is the unincorporated York County zoning ordinance, so it governs areas like Lake Wylie and India Hook. Rock Hill, Fort Mill, Tega Cay, Clover and the City of York are separately incorporated and license tattoo studios under their own municipal codes.
What happens if a shop opens without approval?
It's a misdemeanor under § 155.9999, and the county can fine the operator up to $500 per day the violation continues, on top of pursuing an injunction or revoking any related zoning approval through the Planning and Development Services Department.
