Full Breakdown

Article V of Chapter 38 regulates tattoo parlors and artists countywide. Sec. 38-171 makes it unlawful to own or operate a tattoo establishment, or to work as a tattoo operator or artist, without first obtaining a permit from the local health department. Before a permit issues, Sec. 38-173 requires the applicant to complete a health-department-approved training program in sterilization methods, or present evidence of equivalent coursework, and Sec. 38-174 requires the applicant to pass an examination on the article's provisions. Sec. 38-175 conditions issuance of an establishment permit on a health department inspection of the premises and equipment; a nonconforming premises must be refused a permit.

Violations & Fines

Sec. 38-138 makes tattooing or operating without a required permit, or while a permit is suspended or revoked, a class C misdemeanor punishable only by a fine of not more than $50.00. A court must revoke the permit of anyone convicted of two separate violations within a 24-month period. The health department separately enforces via Sec. 38-179's semiannual inspections, which can suspend or revoke a permit for noncompliant conditions.
