Rutherford County, NC Business Licensing & Operations: Tattoo & Body Modification (2026)

The School Zone Protective Ordinance of Rutherford County, codified at Code Sec. 3-176 et seq., lists tattoo parlors and body piercing establishments among the 'other uses' barred from school zones, alongside amusement parks, commercial game rooms, motor sports facilities, and sexually oriented businesses (Sec. 3-180). Sec. 3-181 sets the restricted distance at 2,000 feet, measured from the proposed building location or the nearest point of operation to the boundary of any public primary, secondary K-12, or public charter school in the county; the same measurement applies even where the school sits inside a municipality that has not adopted extraterritorial zoning.

The ordinance applies only to unincorporated areas outside any municipality's extraterritorial jurisdiction (Sec. 3-179), and the county building inspector may require a survey plat to confirm the distance before a use is sited (Sec. 3-182). A tattoo parlor or piercing establishment already operating within 2,000 feet when the ordinance took effect on January 1, 1992 is grandfathered and may even expand (Secs. 3-167, 3-185). Violations are a misdemeanor punishable under G.S. 14-4, with every day of continued violation charged as a separate offense, and the Board of Commissioners may additionally impose civil penalties of up to $500.00 per day, recoverable as a civil debt if unpaid within thirty days, or seek a Superior Court injunction to stop the operation (Sec. 3-183).
