Full Breakdown
Sec. 10-729 of the Vaping Ordinance bars any business, employee, or agent from selling, giving, or delivering a vapor-generating device or vapor product to someone under 21, and requires sellers to check a government-issued ID. Retailers must post a conspicuous sign warning that sales to under-21 buyers violate county ordinance, and must display checkout-counter material with a birth-date cutoff to help staff judge legal age. The article does not separately license or zone vape retailers; it regulates the sales transaction itself.
Violations & Fines
Selling to a minor is prosecuted as a second-degree misdemeanor against the business and the employee; failing to post the required signs or point-of-sale material is a non-criminal code violation against the business.
