Summary

Marin County limits medicinal cannabis delivery-only retailers to five specific zoning districts and keeps them 600 feet from every school, day care center, youth center, and playground in unincorporated areas. Section 5.90.061 sets both the location and buffer rules, on top of a hard cap of four total licenses countywide.

These county ordinances apply to unincorporated areas of Marin County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)A MCDORe may only be located within the following coastal and non-coastal zoning districts: C1, CP, AP, OP, and IP.(b)A MCDORe shall not be allowed within the specified distances to the following uses that are in existence at the time the license is issued. The distance specified in this section shall be measured in the same manner as provided in subdivision (c) of California Health and Safety Code Section 11362.768, as may be amended from time to time. Specifically, the following buffers shall apply:(1)Within a six hundred-foot radius of a school, day care center, or youth center as required by California Business and Professions Code Section 26054, as may be amended from time to time.(2)Within a six hundred-foot radius of a playground, which is in addition to the uses required per California Business and Professions Code Section 26054.

Full Breakdown

061, adopted by Ordinance No. 3678 in 2017, restricts where a Medicinal Cannabis Delivery-Only Retailer (MCDORe) may locate in unincorporated Marin County. An MCDORe, a retailer closed to the public that sells exclusively by delivery, may only operate in the C1, CP, AP, OP, and IP coastal and non-coastal zoning districts. 768(c): a retailer cannot locate within a 600-foot radius of a school, day care center, or youth center, mirroring the state buffer required by Business and Professions Code Section 26054, and it separately cannot locate within a 600-foot radius of a playground, a buffer the county added on its own authority beyond what state law requires.

These distance and zoning rules apply only to uses that already existed when the license was issued. 071 stating the county's intent to maintain at least two but no more than four licenses at any time. Getting one of those licenses is a four-phase process run by the county administrator and Community Development Agency: a background-check prescreening, a 100-point scored application covering business plan, operating plan and public-benefits plan, a site-review pre-submittal meeting, and finally a formal site review before the Board of Supervisors decides at a public hearing.

Applicants must score at least 80 percent to advance past Phase 2, and a lottery breaks ties when more qualified applicants exist than available licenses.

Violations & Fines

Locating or operating an MCDORe inside a prohibited zoning district or within 600 feet of a school, day care, youth center, or playground is enforced under Section 5.90.140, which authorizes the county to pursue any civil, criminal, or administrative remedy available under the Marin County Code. A license found to violate the location standards can be suspended, modified, or revoked under Section 5.90.100, subject to appeal under Section 5.90.110.

Frequently Asked Questions

How far must a Marin County cannabis retailer be from a school?
Section 5.90.061(b)(1) bars a Medicinal Cannabis Delivery-Only Retailer from locating within a 600-foot radius of a school, day care center, or youth center, measured the same way as California Health and Safety Code Section 11362.768(c), matching the buffer required by state Business and Professions Code Section 26054.
Does Marin County require a cannabis buffer around playgrounds too?
Yes. Section 5.90.061(b)(2) adds a separate 600-foot buffer from any playground, imposed on top of the school, day care, and youth center buffers already required by state law.
How many cannabis retail licenses does unincorporated Marin County allow?
Up to four Medicinal Cannabis Delivery-Only Retailer licenses under Section 5.90.060, and the county's stated intent in Section 5.90.071 is to maintain between two and four licenses at any given time, all delivery-only and closed to walk-in customers.
