It shall be unlawful to operate or to cause or permit the operation of a Medical Marijuana Business:1.In any location that does not comply with the Lakewood Zoning Ordinance, except that any business for which the City of Lakewood had issued a sales tax license for a Medical Marijuana Care-giver Facility prior to the effective date of this Ordinance 0-2010-1 for a location that is not in a zone district in which a Medical Marijuana Center is a permitted use may continue to operate as a legal non-conforming use subject to the provisions of Article 16 of Title 17 of the Lakewood Municipal Code;2.Within 3,000 feet of any other licensed Medical Marijuana Center or Retail Marijuana Store;3.Within 1,000 feet of any elementary, middle or high school, or any athletic facilities associated with such schools.B.For the purposes of this section, the minimum distance shall be measured in a straight line, without regard to intervening structures, from the nearest property line of one Medical Marijuana Business to the nearest property line of the parcel on which the structure of another Medical Marijuana Business is located, or to the nearest property line of the parcel on which the school or athletic facility is located, whichever is applicable.
