Summary

Lane County's marijuana rules measure buffers from property lines and neighboring dwellings, not from schools or parks. Outdoor production needs 100 feet from any exterior property line, indoor production and processing structures need 30 feet from the line or 100 feet from an off-site dwelling, and exhaust vents must be angled and distanced from any dwelling within 1,000 feet.

These county ordinances apply to unincorporated areas of Lane County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a) Setbacks. (i) Outdoor production. Outdoor marijuana production must be located at a minimum of 100 feet from any exterior property line. (ii) Indoor production. Any structure used for indoor marijuana production or marijuana processing must be located a minimum of 30 feet from a property line, or 100 feet from an existing dwelling that is not located on the same property as marijuana production or marijuana processing use, whichever is greater. [...] (vii) The opening for any exterior exhaust vent for the ventilation system must: 1. Be in a location that provides the greatest distance between the opening for the exterior exhaust vent and any dwelling that is not on the subject property, located within 1000 feet of the opening for the exterior exhaust vent. 2. Be oriented in a direction that is at least 45 degrees away from any dwelling that is not on the subject property, located within 1000 feet of the opening for the exterior exhaust vent.

Full Breakdown

420(4)(a) sets two distinct setbacks. Outdoor marijuana production must sit at least 100 feet from any exterior property line. A structure used for indoor marijuana production or processing must be set back the larger of two numbers: 30 feet from a property line, or 100 feet from an existing dwelling that is not on the same property as the marijuana use, whichever distance is greater. 420(4)(b) requires every production or processing building, including greenhouses and hoop houses, to run an activated charcoal or carbon filtration or equivalent ventilation system, with a design stamped by an Oregon-licensed mechanical engineer and fans sized to the building's cubic footage divided by three.

Subsection (4)(b)(vii) then adds the long-range buffer: the exterior exhaust vent opening must be sited to maximize distance from any off-site dwelling located within 1,000 feet of the vent, and must be oriented at least 45 degrees away from any such dwelling. An alternative ventilation system is allowed only if an engineer's stamped submittal shows it filters air as well as or better than the required carbon system. 420(4)(c): grow lights inside a building or greenhouse must be shielded from surrounding property from sunset to sunrise, and outdoor marijuana grow lights may not be illuminated at all during those hours.

None of these standards reference schools or parks; Oregon's separate OLCC licensing process, not the Lane Code, is what runs any state-level proximity screening for those uses.

Violations & Fines

A production or processing structure sited inside the 100-foot outdoor or 30/100-foot indoor setback, or an exhaust vent that isn't angled and distanced as 16.420(4)(b)(vii) requires, fails the site plan review the Lane County Planning Director conducts at the OLCC Land Use Compatibility Statement stage. Ventilation and lighting plans must be engineer-stamped and submitted before approval, and noncompliant equipment or an unshielded grow light running outside the sunset-to-sunrise limits is enforceable through Lane County's standard land use compliance process.

Frequently Asked Questions

How far must an outdoor marijuana grow be from my property line in Lane County?
At least 100 feet from any exterior property line under Lane Code 16.420(4)(a)(i). Indoor production or processing structures use a different measure: 30 feet from the property line or 100 feet from an off-site dwelling, whichever distance is larger.
Does Lane County require marijuana buffers from schools or parks?
No. Lane Code 16.420(4) buffers marijuana production and processing from property lines and neighboring dwellings, plus a 1,000-foot exhaust vent siting rule and a 45-degree vent orientation requirement. It does not set a school- or park-specific distance; that kind of screening runs through Oregon's OLCC licensing process instead.
Can I use an alternative ventilation system instead of carbon filters?
Yes, if a mechanical engineer licensed in Oregon stamps a submittal demonstrating the alternative system filters air as well as or better than the required activated charcoal or carbon filtration system under Lane Code 16.420(4)(b)(viii).
