Dayton, OH Cannabis Regulations: Dispensary Zoning (2026)

The zoning code (Chapter 150 R.C.G.O.) at § 150.200 defines four marijuana establishment types, cultivation, processing, dispensary, and laboratory, each operating in accordance with the marijuana/cannabis licensing laws of the Ohio Revised Code. Schedule 150.340.2 lists marijuana establishment, laboratory and marijuana establishment, processing as permitted uses by right in the I-1 Light Industrial and I-2 General Industrial districts, while marijuana establishment, dispensary is only a conditional use there. Dispensary and laboratory uses are also permitted in the Downtown UBD/CBD districts under Schedule 150.320.2, and a dispensary is a permitted use in the Mixed-Use Hub under Schedule 150.330.2. The city does not license operators; Ohio Revised Code chapters 3780 and 3796 control who may hold a marijuana license.
