Texas permits only a very limited form of medical cannabis through the Compassionate Use Program (TCUP) administered by the Texas Department of Public Safety. TCUP authorizes a small number of licensed dispensing organizations statewide to cultivate, process, and dispense low-THC cannabis (not more than 1% THC by weight) to qualifying patients with specific conditions such as epilepsy, multiple sclerosis, PTSD, and certain cancers. Dispensing organizations may only operate from their TCUP-licensed facility; retail storefronts as in other states are not part of the program. Delivery to patients is handled through secured transport from the licensed organization. CBD retail stores selling hemp-derived products (0.3% THC or less) operate under Texas Department of State Health Services hemp consumable rules and are zoned as general retail in DeSoto. Any future expansion of Texas cannabis laws would still require state licensing before municipal permitting.
