101. Producers and processors are restricted to the CG zone and barred from every other zone. Retailers get a broader set of commercial zones, BC, BD, BN and CG, but only where those zones fall inside one of seven areas the comprehensive plan map designates as an activity center: the Downtown/Waterfront Activity Center, the Medical/Highway 99 Activity Center, the Westgate Community commercial area, the Five Corners neighborhood commercial area, the Perrinville neighborhood commercial area, the Highway 99 corridor, and the Edmonds Way corridor. 010. Medical marijuana facilities, including dispensaries, access points and collective gardens operating without a valid Washington State Liquor and Cannabis Board license, are barred outright, everywhere in the city, with no zone exception.

110 further requires all cultivating, processing, displaying, manufacturing, selling and storage to be conducted out of public view, bans visible marijuana or paraphernalia from outside the licensed premises, and holds the property owner and licensee jointly liable for any odor, smoke, dust or fluid escaping the business, with a duty to fully clean up any such condition.

Violations & Fines

Operating a marijuana producer, processor or retailer outside its permitted zone, inside a residential district, or as an unlicensed medical dispensary is a zoning violation subject to the city's standard code enforcement process. Allowing marijuana odor, smoke, dust or paraphernalia to be visible or detectable from outside the premises makes the property owner and licensee jointly and severally liable for cleanup.
