(a)No applicant shall be issued a retail marijuana store license if, at the time of application for such license, such location is: ... (4)Within the boundaries of any RUL, UE, RF, RL, LMN, MMN, OT or HMN zone district;(5)In a residential unit;(6)Within five hundred (500) feet of a residential unit; or(7)Within one thousand (1,000) feet of another medical marijuana or retail marijuana store.(b)The distances described above shall be computed by direct measurement in a straight line from the nearest property line of the parcel of land on which the protected use is located to the nearest portion of the building or unit in which the proposed retail marijuana store would be located.

The medical marijuana article carries the identical eight-district exclusion at § 15-475(a)(4), so a location has to clear the same zoning test whether the applicant is opening a medical or a recreational store. Fort Collins has not opted out of retail marijuana sales: Article XVII, Division 3 (§§ 15-607 through 15-628) creates a full license track for retail marijuana stores, cultivation facilities, products manufacturers, testing facilities, and business operators, so a compliant location in an eligible commercial or industrial zone can still obtain a license through the Retail Marijuana Licensing Authority.
Violations & Fines
A store proposed for an excluded zone district or within the residential or store-to-store buffers will have its application denied under § 15-613. An operating store found out of compliance can face suspension, revocation, or nonrenewal after notice and hearing, and any person who violates the Article, including a licensee or employee, is guilty of a misdemeanor under § 15-624, punishable per § 1-15.
