Mahwah Township Council opted out of permitting cannabis businesses, prohibiting all six classes of cannabis establishments within the township. Subsequent retail proposals have been rejected, and dispensaries are not authorized to operate anywhere in Mahwah under current zoning.
On July 8, 2021, the Mahwah Township Council adopted an ordinance opting out of permitting cannabis businesses under the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (CREAMMA). All six classes of licensed cannabis establishments, including cultivators, manufacturers, wholesalers, distributors, retailers, and delivery services, are prohibited within Mahwah. A subsequent December 2021 ordinance proposing retail cannabis on Route 17 North failed Council approval. The Planning Board separately recommended any future retailers be sited at least 1,000 feet from schools and houses of worship.
Operating, leasing, or constructing space for any class of cannabis establishment in Mahwah without state licensure permitted by local ordinance is a zoning violation. Property owners and operators are subject to enforcement by the township zoning officer and code enforcement.
