Teaneck initially opted out of cannabis retail establishments under state law and continues to restrict dispensary operations within township limits.
When the New Jersey CREAMM Act took effect, municipalities had until August 2021 to opt in or out of allowing cannabis businesses. Teaneck's Township Council adopted an ordinance prohibiting all six classes of cannabis establishments, including retail dispensaries, within municipal boundaries. Under state law a five-year opt-out is binding, after which the council can revisit the issue. Any future dispensary would also need to satisfy zoning, distance, and licensing requirements adopted by the township.
Operating an unlicensed cannabis business is a state crime, and zoning violations can lead to municipal court fines and injunctions.
