Adopted by Ord. No. 2956 on October 11, 2022, Garfield's cannabis chapter allows cannabis establishments only as a conditional use, subject to Land Use Board site plan review. Class 5 retail dispensaries must follow parking and loading rules for retail stores and may not be located within 750 feet of a pre-existing public, nonpublic, or charter school listed in the NJDOE School Directory, or within 750 feet of a park or recreational facility, measured in a straight line from the establishment's entrance to the nearest property line. Cannabis establishments cannot operate from homes, apartments, townhouses, condominiums, or mixed-use buildings, and applicants must submit an odor mitigation and ventilation plan. The initial application fee is $20,000 plus licensing fees.
