Murrieta, CA Cannabis Regulations: Dispensary Zoning (2026)

While Business and Professions Code section 26200 gives California cities broad authority to license or prohibit commercial cannabis activity, Murrieta has chosen prohibition. Municipal Code Chapter 8.48 makes it unlawful to operate, establish, or maintain any commercial cannabis business within the city, including retail dispensaries, microbusinesses, cultivation facilities, manufacturing, distribution, and testing laboratories. Delivery businesses based outside Murrieta may still deliver to Murrieta residents under the statewide Bureau of Cannabis Control delivery rule and the outcome of litigation interpreting that rule, but no storefront or delivery hub may be physically located in the city. The ordinance treats any non-conforming cannabis use as a public nuisance subject to injunction, administrative citation, and prosecution as a misdemeanor. Murrieta voters and council have declined several proposals to open the city to regulated retail in recent election cycles. The result is that residents seeking adult-use cannabis typically travel to nearby Perris, Palm Springs, or use state-compliant delivery services originating from other jurisdictions.
