Lake County, CA Cannabis Regulations: Dispensary Zoning (2026)

The county's Zoning Ordinance regulates commercial cannabis through Article 27's use-permit conditions rather than a standalone retail-storefront pathway. Under Sec. 13(aac), a microbusiness license holder may act in part or whole as a distributor, Type 6 non-volatile manufacturer, retailer, and cultivator on an area under 10,000 square feet, but only if the applicant already holds a Type 1 and/or Type 2 commercial cannabis cultivation license plus at least two of three additional license types: a Type 13 self-distribution transport license, a Type 6 non-volatile manufacturing license, or a Type 10/10A dispensary license.

The dispensary component is specifically carved out: Sec. 13(aac)(1)(iii)(a) states that Type 10 and 10A dispensary licenses are not allowed as part of a microbusiness unless the application is coordinated with a resort application, and even then the dispensary must be accessible only to that resort's registered guests, not walk-in members of the public. In practice this means there is no zoning district in unincorporated Lake County, not the C1, C2, C3, CH, CR, M1, M2, or MP commercial and industrial districts, where a general-public storefront dispensary can obtain a use permit; cultivation, manufacturing, distribution, and testing licenses are separately permitted by district in Table B, but retail dispensing to the public sits outside that table entirely.

Commercial cannabis operators must still hold a Lake County minor or major use permit under Sec. 13(at) alongside their state Department of Cannabis Control license before operating any licensed activity, and permits obtained while a state license is delayed are subject to a mandatory one-year review.
