Summary
Any unincorporated Lake County building of 10,000 square feet or more used for manufacturing, storage, warehousing, retail, wholesale, hotel, hospital, mortuary or laundry use must provide at least one off-street loading space under Zoning Ordinance Section 46.17. Additional spaces are required as floor area grows, and each loading bay must meet minimum size, clearance and setback standards.
In any district, in connection with every building, or part thereof, erected and having a gross floor area of ten thousand (10,000) square feet or more, which building is to be occupied by manufacturing, storage, warehouse, goods display, retail store, wholesale store, market, hotel, hospital, mortuary, laundry, dry cleaning or other uses similarly requiring the receipt or distribution by vehicles of material or merchandise, there shall be provided and maintained, on the same parcel with such building, at least one (1) off-street loading space, plus one (1) additional off-street loading space for each twenty thousand (20,000) square feet, or major fraction thereof, of gross floor area. ... Each loading space shall be not less than thirty-five (35) feet in length and twelve (12) feet in width and have an overhead clearance of at least fourteen (14) feet. (d) A loading space shall not be located in a required front yard and shall be screened from adjoining sites by a fence of not less than eight (8) feet when adjacent to an "R" district.
Full Breakdown
17 of the Zoning Ordinance requires off-street loading facilities for any building of 10,000 square feet of gross floor area or more that is occupied by manufacturing, storage, warehouse, goods display, retail store, wholesale store, market, hotel, hospital, mortuary, laundry, dry cleaning, or any similar use that receives or distributes merchandise by vehicle. That threshold triggers one loading space, with an additional space required for every 20,000 square feet of gross floor area beyond that, or major fraction of it, all located on the same parcel as the building.
Retail nurseries are measured by land area instead of building size: they must provide one loading space for every acre of use area. Each loading space has to meet a minimum footprint of 35 feet in length by 12 feet in width, with at least 14 feet of overhead clearance so delivery trucks can maneuver in and out. Placement is restricted too: a loading space cannot sit in a required front yard, and where it is adjacent to an "R" residential zoning district it must be screened by a fence at least 8 feet tall.
The section also requires enough room on-site for vehicles to turn and maneuver, and mandates that required loading spaces never block access to any required parking lot or parking space. These standards apply in any zoning district in the unincorporated county, so a warehouse in the M1, M2 or MP industrial districts faces the same loading-space math as a retail store in a C2 or C3 commercial district.
Violations & Fines
Failing to provide the required loading spaces, or blocking them with parked cars or storage, is a Zoning Ordinance violation enforceable by the Planning Director, Zoning Code Compliance Officer or Building and Safety Director under Article 61. Section 61.4(a) treats a Chapter violation as an infraction punishable by a fine up to $100, or a misdemeanor punishable by a fine up to $500, up to six months in County Jail, or both; each day the violation continues counts as a separate offense.
