Full Breakdown

Kings County Code § 14-51 bans commercial cannabis activity, cultivation, processing, distribution, sale, delivery, and testing, in every zone in the unincorporated county, with no exception by district. Adopted by Ordinance No. 677 in October 2016, the ban covers marijuana businesses, cooperatives, and collectives of any kind. Violation is both a public nuisance, abatable under §§ 14-56–14-57, and a misdemeanor under § 14-51(c); each day of an ongoing violation is a separate offense. There is no zoning district, permit, or licensing pathway for a cannabis business anywhere in the unincorporated county.

Violations & Fines

Operating any commercial cannabis business is a public nuisance abatable by the county and a misdemeanor punishable by up to a year in jail, a $1,000 fine, or both, under §§ 14-51(c) and 14-55.
