Florida Statute ยง381.986 governs medical marijuana under the Compassionate Medical Cannabis Act. Only licensed Medical Marijuana Treatment Centers (MMTCs) may legally cultivate cannabis. Patients with qualifying conditions and a state ID card may purchase from MMTCs but cannot grow their own. Amendment 3 (recreational cannabis) failed in November 2024 with 55.9% support, falling short of the 60% supermajority required. Home cultivation by patients or recreational users remains a felony under FL ยง893.13. Palm Beach County has no local cultivation authorization.
Cultivation of any amount: third-degree felony, up to 5 years prison and $5,000 fine. Cultivation of 25+ plants: second-degree felony, up to 15 years and $10,000.
