Minnesota legalized recreational cannabis in 2023 under MN Statute 152.02, and adults 21 and over may cultivate up to 8 plants at home (no more than 4 flowering) in Minneapolis. Plants must be in an enclosed, locked space not visible from public areas and accessible only to adults.
Minnesota Statute Chapter 342 and amendments to 152.02 legalized adult-use cannabis effective August 1, 2023. Home cultivation for personal use is permitted statewide for adults 21 and older, with a limit of 8 plants per residence (regardless of number of adults) and no more than 4 mature flowering plants at one time. The plants must be grown in an enclosed, locked space that is not visible to the public and cannot be accessed by persons under 21. Outdoor growing is permitted if the area is secured by a locked enclosure, fenced and out of public view. Minneapolis cannot ban home cultivation under state preemption. Harvest is capped at 2 pounds per household for storage at the residence. Sharing up to 2 ounces with another adult is legal without compensation. Commercial cultivation requires a state cannabis business license through the Office of Cannabis Management (OCM) and is subject to local zoning.
Specific penalty amounts for this ordinance are not published in a publicly accessible fine schedule. Contact Minneapolis code enforcement directly for current fines, enforcement procedures, and hearing options.
