Growing marijuana at home is a crime everywhere in Indiana, including St. Joseph County. Indiana has no medical or recreational program. Under IC 35-48-4-11, knowingly growing or cultivating marijuana is possession of marijuana, a Class B misdemeanor that escalates with quantity and priors.
Indiana has no legal recreational or medical cannabis and no home-grow allowance. IC 35-48-4-11 makes possessing marijuana, and specifically growing or cultivating it, the offense of possession of marijuana, a Class B misdemeanor at the base level. The statute also covers a person who knows marijuana is growing on their premises and fails to destroy the plants. A cultivated crop can support the more serious charge of dealing in marijuana under IC 35-48-4-10, a Class A misdemeanor that rises to a felony by amount or prior conviction. There is no medical-cannabis card, dispensary, or caregiver exception in Indiana that authorizes any resident to grow their own plants.
Base possession is a Class B misdemeanor punishable by up to 180 days in jail and a $1,000 fine; a larger grow or prior conviction raises it to a Class A misdemeanor or a felony, and cultivation can be.
