Full Breakdown

Section 4.1-1101 of the Code of Virginia lets a person 21 years of age or older cultivate up to four marijuana plants for personal use at their place of residence. The cap belongs to the household, not the individual. The statute says a household can never hold more than four plants at any point, and it defines a household as the people who live in the same house or other place of residence, related or not. Two adults sharing a Sterling townhouse or a Purcellville single-family home therefore split one allowance of four plants between them. Growing is also limited to the grower's main place of residence, so a second home, a rented garage across town, or a friend's yard in Ashburn does not qualify.

Three conditions attach to every grow. First, no plant can be visible from a public way without the use of aircraft, binoculars, or other optical aids. A plant a passerby on the street can see with the naked eye breaks the rule, while one seen only from a drone or through a telescope does not. Second, the grower must take precautions to prevent unauthorized access by anyone younger than 21. Third, each plant must carry a legible tag showing the grower's name, driver's license or identification number, and a notation that the plant is grown for personal use as authorized under the section. A tag on every plant means a household with four plants carries four copies of the grower's identifying details.

These are statewide rules, so they apply at every address in the county, including inside the incorporated towns of Leesburg, Purcellville and Middleburg. Enforcement in Loudoun runs through the Loudoun County Sheriff's Office and the town police departments, with cases heard in Loudoun General District Court. The statute makes penalties for violations by an adult prepayable under the procedures in § 16.1-69.40:2. The section's history line lists acts of 2021, 2022, 2023 and 2026, and the text quoted here is the version read on October 12, 2026.

Violations & Fines

Growing more than four but no more than 10 plants draws a $250 civil penalty for a first offense, a Class 3 misdemeanor for a second, and a Class 2 misdemeanor for a third and any later offense. More than 10 but no more than 49 plants is a Class 1 misdemeanor, more than 49 but no more than 100 is a Class 6 felony, and more than 100 is a felony carrying one to 10 years in prison or a fine up to $250,000, or both. Breaking the visibility, access or tag rules carries a civil penalty of no more than $25.

Frequently Asked Questions

Can two adults in the same Loudoun County home each grow four plants?
No. The limit is four plants per household, and the statute says a household can never contain more than four at any point. A household means everyone living in the same house or other place of residence, whether related or not. Two adult roommates in a Leesburg apartment share one cap of four plants, not eight.
Can I grow at a second home or rental property in Loudoun?
No. Section 4.1-1101 allows cultivation only at the grower's main place of residence. A vacation house, a rented outbuilding, or a relative's property does not qualify even if the grower is 21 or older. Plants grown at any other location fall outside the personal-use allowance and are counted under the over-limit penalties.
What happens if a neighbor or passerby can see my plants from the street?
The statute requires that no plant be visible from a public way without the use of aircraft, binoculars, or other optical aids. A plant visible to the naked eye from the street or sidewalk violates that rule and carries a civil penalty of no more than $25, which an adult can prepay under § 16.1-69.40:2.
What is the penalty for growing five or six plants instead of four?
Possession of more than four but no more than 10 plants is a $250 civil penalty for a first offense. A second offense is a Class 3 misdemeanor, and a third or any later offense is a Class 2 misdemeanor. The penalties climb to a Class 1 misdemeanor once the count passes 10 plants.
Do the plant tags have to show my real name?
Yes. Each plant needs a legible tag with the grower's name, driver's license or identification number, and a notation that the plant is being grown for personal use as authorized under the section. A missing or unreadable tag is a violation of subsection B and carries a civil penalty of no more than $25.
