Health and Safety Code §11362.2 lets any adult 21 or older cultivate up to six living cannabis plants inside their primary residence or in a fully enclosed and locked accessory structure. Local jurisdictions may not ban indoor cultivation, but can ban outdoor cultivation, and OC unincorporated areas do precisely that. The grow area must not be visible from public view, must be secured against minors, and the dwelling must remain a residence (not converted to a commercial grow). Harvested cannabis above one ounce must remain at the residence. Violation of indoor cultivation rules is an infraction with a $100 fine first offense.
Exceeding six plants is a misdemeanor with fines up to $500 and possible jail; visible outdoor cultivation in unincorporated OC is a code-enforcement infraction subject to escalating administrative penalties.
