In the Town of Tonawanda, a building permit is required before any swimming pool goes in, whether in-ground or aboveground, because Town of Tonawanda Code § 54-5 treats a pool as a structure. The Code Enforcement Officer's exemption list specifically refuses to exempt pool enclosure fencing, so a fence that ordinarily needs no permit does need one when it surrounds a pool. Every pool must also meet residential setback rules and conform to the New York State Residential Code.
