Full Breakdown

Sec. 11-4(a)(3) is the list of what the city treats as a public nuisance on any lot or parcel. It covers any condition or use of a lot or structure detrimental to the value, use or enjoyment of nearby property, including the conditions defined in Secs. 11-1, 11-2 and 11-3 and structures that become unfit and unsafe for human habitation; the accumulation of rubbish outside any building; junked, wrecked or non-operative mobile or manufactured homes that are not inhabited; animal sound or odors that unreasonably interfere with another lot's use; rubbish on a public sidewalk that the abutting owner does not remove within a reasonable period; graffiti; and equipment stored in a front or side yard where it can be seen from a public street while it cannot do what it was designed to do.

Enforcement runs through the Code Enforcement Board, a five-member body created under KRS 65.8801 through 65.8839. Members must live in Nicholasville, and regular meetings fall on the third Tuesday of every month. A Codes Enforcement Officer, defined as a city police officer, safety officer, citation officer or other public law enforcement officer with authority to issue a citation, writes the citation. A violator who neither pays nor contests within seven (7) days gets a final order. A contested citation goes to a hearing, with notice not less than seven (7) days before, and the board can impose a fine up to the ordinance maximum, require the violation to be remedied, or both. The board has no authority over conduct that is also a criminal offense or a moving motor vehicle offense under Kentucky statutes. Appeals go to Jessamine County District Court within thirty (30) days of the order.

Violations & Fines

Under Sec. 11-4(k)(4), every separate occurrence and every day of a continuing occurrence is a separate violation. Uncontested civil fines for a first, second and later offense are: Animals $25, $50, $100; Building and Construction Code $100, $150, $200; Garbage $50, $100, $150; Occupational License $50, $100, $150; Weeds $50, $100, $150. After a hearing the maximums rise, to $1,000 for a later Building and Construction Code or Occupational License offense. Each violation is also a misdemeanor, with a criminal fine up to $500 or up to twelve (12) months in jail, or both.

Frequently Asked Questions

What counts as a nuisance violation in Nicholasville?
Sec. 11-4(a)(3) lists them: conditions harming nearby property, including those in Secs. 11-1 through 11-3, unfit structures, rubbish outside a building, junked mobile homes, animal noise or odors, rubbish on a public sidewalk, graffiti, and nonworking equipment stored in a front or side yard visible from a public street.
Who issues the citation and who decides a contested one?
A Codes Enforcement Officer, meaning a city police officer, safety officer, citation officer or other public law enforcement officer with citation authority, issues it. A contested citation is heard by the Code Enforcement Board, which takes sworn testimony and decides whether a violation was committed.
How long do I have to respond to a citation?
Seven (7) days. Sec. 11-4 treats a citation that the violator neither paid nor contested within seven (7) days as a final order. A person who requests a hearing and then fails to appear is deemed to have waived the hearing, and the citation as issued becomes the final order.
Can I appeal a Code Enforcement Board order?
Yes, but only after a hearing. Sec. 11-4(k)(1) allows an appeal of a final order issued after a hearing to Jessamine County District Court within thirty (30) days of the date the order is issued, started by filing a complaint and a copy of the final order. Without an appeal in that period the order is final for all purposes.
