Permit Requirements

No dwelling in Orleans Parish may be a short-term rental unless the owner holds a valid STR owner permit and designates an operator with a valid operator permit. Permits are one-year, personal, non-transferable, and issued as Type N (non-commercial) or Type C (commercial).

Noise Rules

STR use that generates excessive loud sound is a prohibited act. Between 10 p.m. and 8 a.m., noise louder than a conversational level, or music plainly audible from the property line, is a violation. Commercial STRs must install a noise-monitoring device.

Taxes & Fees

There is a $50 non-refundable application fee, a $500 annual Type N (or $1,000 Type C) owner permit fee, and a $12-per-night occupancy fee remitted with tax submissions. Booking platforms must collect and remit sales/use taxes and the nightly fee.

Parking Rules

Every short-term rental application must include a site plan showing the location of any required parking. Under the Comprehensive Zoning Ordinance, STRs must generally provide one off-street parking space per two guest bedrooms, the same ratio as a bed-and-breakfast or hotel.

Occupancy Limits

Short-term rentals may not exceed the guest-bedroom, guest-occupancy, and density limits in the Comprehensive Zoning Ordinance. Generally occupancy is capped at two guests per bedroom, and a dwelling unit is limited to five guest bedrooms and no more than ten occupants.

Insurance Requirements

Night Caps

New Orleans caps STRs by density rather than nights: in residential and neighborhood-business districts only one large residential STR is allowed per block face, awarded by lottery. Short-term rentals are banned outright in the Vieux Carre (French Quarter) and the Garden District.

Host Presence Rule

A licensed operator must be available during all periods of guest occupancy, including nights and weekends. The operator must be reachable by phone and able to resolve guest, neighbor, and city complaints within one hour, and must live on the same lot for non-commercial STRs.

Primary-Residence-Only Rule

Non-commercial short-term rentals must be operator-occupied. Only a natural person may hold one, no more than one per person, and the operator must live on the same lot as the rental. Whole-home, non-owner-occupied STRs are banned in residential districts.
