Albemarle County, VA Curfew Laws: Juvenile Curfew (2026)

Sec. 10-101 defines a minor as anyone under 18 and a custodian as an adult temporarily entrusted with a minor's care by the minor's parent or guardian. m. Subsection C lists five exemptions: a minor accompanied by a parent, guardian, or custodian; a minor on an emergency errand carrying a signed written consent; a minor going to or from an activity sponsored by the county, a public school, a licensed private school, a church, or another religious organization, again with signed written consent in hand; a minor engaged in lawful employment or traveling directly to or from work; and a minor engaged in other legitimate business activity with signed written consent.

Subsections D and E extend liability beyond the minor: a parent, guardian, or custodian who knowingly permits, allows, or encourages a minor to violate the curfew is guilty of an offense, and so is the owner or operator of a vehicle who knowingly permits, allows, or encourages a minor to violate it. Subsection F makes every violation of the section a class 4 misdemeanor. The ordinance traces to the 1967 and 1988 county codes and was last amended by Ord. 2-926 to establish a curfew for minors.
