Albuquerque Revised Ordinances Β§12-2-22 imposes a nighttime curfew on persons under 18. School nights (Sunday-Thursday) curfew runs 11 PM to 5 AM, and Friday/Saturday runs midnight to 5 AM. Exceptions include: accompanied by a parent or guardian, traveling to/from work or school-sponsored activity, responding to an emergency, exercising First Amendment rights, or on the sidewalk of the minor's own home. Bernalillo County unincorporated areas do not have a county curfew ordinance; instead, the NM Children's Code (NMSA Β§32A-1-1 et seq.) and the Children's Shelter Care Act apply, and BCSO may take a minor into protective custody if unsupervised at late hours. APD enforces the ABQ curfew primarily by returning minors home; parents receive a written warning on first violation and a citation on subsequent offenses. Some NM city curfews have faced constitutional challenges; ABQ's has been upheld with the listed exceptions.
