Summary
Outside incorporated cities, Clackamas County Code 6.01.020 bars minors under 18 from streets, parks and other public places during set curfew hours unless accompanied by an adult 21 or older with custody authority, or engaged in a lawful activity requiring their presence. The hours and cutoff age differ for younger children and teens, and shift again in summer.
It shall be unlawful for any minor under 18 years of age to be, or remain, in or upon any street, highway, park, alley or other public place between the hours specified herein, unless such minor is accompanied by a parent, guardian or other person 21 years of age or over ... 1. Adopted under ORS 419C.680(4), which lets a county set curfew hours for minors in the unincorporated area different from, and in addition to, the state's default hours, Code 6.01.020 splits minors into two age-and-school bands. Minors under 14 who have not yet started high school face curfew between 9:15 p.m. and 6:00 a.m. the following morning, moving to 10:15 p.m. to 6:00 a.m. during June, July and August. Minors 14 or older, or who have begun high school, face curfew between 10:15 p.m. and 6:00 a.m. on Sunday through Thursday nights, extending to midnight on Friday, Saturday, or any night before a school holiday, and shifting to a flat midnight-to-6:00 a.m. window during June, July and August.
The ordinance carries two built-in exceptions: a minor accompanied by a parent, guardian, or another person 21 or older who is authorized to have care and custody of the minor is not in violation, nor is a minor engaged in a lawful pursuit or activity that requires their presence in the public place during curfew hours, such as a job or a school event. Because the ordinance applies only outside incorporated cities, it governs unincorporated communities such as Oak Grove, Jennings Lodge, Clackamas and Damascus, but not Oregon City, Milwaukie, Gladstone, Happy Valley or the county's other incorporated cities, which set their own curfews if any. A minor who is emancipated under ORS 419B.550 to 419B.558 is exempt entirely.
